Injured Kerr 'hit by drunk driver'

MORE photos have emerged of supermodel Miranda Kerr wearing a neck brace after she was injured in a car accident in Los Angeles.

Kerr has been spotted entering her hotel, the famous Chateau Marmont on Sunset Boulevard in LA, wearing her neck brace after the car accident.

Kerr was injured in the crash, and taken to hospital.

She was left with whiplash and damage to her back.

Today she has been spotted leaving the hotel in her assistant's car.

Annie Kelly, Kerr's Australian publicist, confirmed the face of David Jones, who was a passenger in the car, was the victim of an alleged drunk driver.

The mother-of one was with an assistant when another vehicle apparently rammed into them.

Kerr's mother Therese has also thanked everyone for their well wishes on her Instagram account.

She wrote: "I've had lots of people on social media asking if Miranda is ok.

"Thank you all for your beautiful thoughts, prayers and well wishes, it means so much to us.

"Please know that Miranda is fine. She was involved in a car accident and is currently having to wear a neck brace, but thankfully she is ok and Flynn wasn't in the car with her.

"Everyone is fine so please don't worry.

"Sending you all much love and gratitude xxx"

When Kerr was taken to hospital, she underwent scans and is now recovering at home.

Neither her movie star husband, Orlando Bloom, or young son Flynn was in the car at the time.

Kelly said Bloom was now by her side.

"He's taking very good care of her. He's an amazing husband," she said.

"Luckily, Flynn wasn't in the car," Kelly says of Kerr's two-year-old son.

The driver of the other car has been arrested and is expected to be charged by Los Angeles by police.

The accident is not expected to disrupt Kerr's commitments and she is due to return to Sydney next month for the launch of the new Qantas uniforms, designed by Paris-based Australian fashion designer Martin Grant.

When she was only 15 Kerr said went through a deep depression after her boyfriend Chris Flynn was killed in a car crash. Her child Flynn is named after him.

NSW police are still investigating a hacking incident when Kerr was in Sydney last month.

She told NSW Cyber crime police one of her social media accounts had been compromised and threats made against her and her family.

Queensland taxi driver stabbed in neck

A TOWNSVILLE taxi driver has been stabbed in the neck during a fight with two passengers.

The 56-year-old driver was attacked as he dropped off two men early on Monday morning.

He was punched in the face before being stabbed in the neck with a small knife. His injuries are not considered life threatening.

The two men fled the scene.

Police have since charged a 21-year-old man with wounding. He's due to face Townsville Magistrates Court on Monday.

THE father of a woman who needs round-the-clock care after a driver lost control of his car and smashed into her and her baby daughter has slammed the "disgraceful" leniency of the sentence.

Bryce James Wayland, 27, was yesterday ordered to perform 50 hours of community service and was banned from driving for 15 months after his Lexus mounted the kerb and hit Emma De Silva, now 36, and her 19-day-old daughter as they walked on a footpath next to the Princes Hwy at St Peters in March 2011.

Ms De Silva spent two months in hospital with critical head injuries and continues to receive daily rehabilitation as she re-learns basic skills.

She suffers seizures and needs a walking frame to move around the house, where she lives with the help of her family and carers.

Her baby escaped without long-term injuries.

Magistrate Graeme Curran said while the victim's injuries were serious, Wayland's culpability was "very low" and the driver was left in a "sorry situation".

"Weighed against this is the undeniable tragedy that Ms De Silva and her family and friends have to endure for the rest of her life," he said.

Speaking from the Penrith home he now shares with his daughter, Ms De Silva's father Keith Freeman told The Daily Telegraph that Wayland hadn't been made to face the consequences for the "lives he destroyed".

"I think it's disgraceful. Our lives are completely shattered and what he has got is probably less than you would normally get for being caught speeding," he said.

"He should be made to realise what he's done to Emma. She had a happy life, she had a family, she had a great job and it's all gone."

Mr Freeman said no penalty would change what happened to his daughter, but he believed Wayland deserved a harsher punishment than community service.

Mr Curran yesterday said the driver would experience the community service hours "far more onerously than the average member of the population" because he suffered a serious medical condition called Crohn's disease.

Wayland was last year found guilty of negligent driving causing grievous bodily harm, which carries a maximum nine-month jail term and a three-year licence ban.

He failed to apply the brakes and instead steered on to the footpath after his accelerator pedal became stuck under the floor mat while he was driving home from work, the court previously heard.

A statement from Wayland's parents to the court said they were "immensely proud of their son", although he had changed from being "happy, carefree and diligent" to "withdrawn and depressed" after the crash.

Mr Curran said he had no doubt the driver was very remorseful.

Wayland didn't comment as he left the Downing Centre Local Court yesterday.
